The United States invoked the Rapid Response Labor Mechanism in the USMCA to review alleged worker rights violations at Madobox in Mexico, the Office of the US Trade Representative said.

The request for review follows a petition from a Mexican labor union alleging interference with union activity at the Madobox facility.

The facility, located in Uruapan, Michoacán, produces boxes for commercial use.

The petition alleges Madobox unlawfully arranged a collective bargaining agreement without workers and coerced employees regarding their rights.

The union, Sindicato Nacional de Trabajadores y Empleados de la Industria del Comercio, Alimenticia, Textil, Automotriz, Metalúrgica, Servicios y Distribución “Generalísimo José María Morelos y Pavón”, is affiliated with the Confederacion Central Nacional (COCENA).

The Interagency Labor Committee for Monitoring and Enforcement determined there was sufficient evidence to invoke the USMCA’s enforcement mechanisms.

As a result, the Trade Representative requested Mexico review whether workers at Madobox are being denied freedom of association and collective bargaining.

The United States has suspended liquidation of unliquidated entries of goods from the Madobox facility.
